Burn Permits

Elbert Fire Protection District requires residents who request an open burn permit (other than recreational fire) to adhere to all state, county, and local regulations, requirements, and restrictions.

Due to new open burning regulations, a state issued permit MAY B E required in addition to a local permit.  State issued permits can be applied for through the Colorado Department of Public Health and Environment at no cost to the applicant.

State Issued Permits

State issued permits are valid for one calendar year (January 1 through December 31) and allow for a maximum of 50 burns within the year.

Local Permits

To obtain a local permit, please apply online or download and complete the burn permit application.  Please email completed application to elbertfire@hotmail.com or deliver to station 231, at 24310 Main Street in person. You may also contact Elbert Fire Protection District directly by calling (303) 648-3000.

APPLICATION MUST BE RECEIVED BY EFPD AT LEAST 72 HOURS PRIOR TO THE DATE THE BURN PERMIT IS NEEDED. 

NOTE: A visual site inspection may be required, which would be scheduled with an EFPD representative.

General Requirements for Local Permits

  •  Permitted must be 18 years of age, own the property or have legal access/permission, and have adequate means of access and sufficient means of communication to EFPD and/or 911 in case of emergency
  • Burn area must be on the ground, NO pits, Barrels, or Incinerators are allowed
  •  Permitted must conduct a controlled burn in the inspected and approved area only during daylight hours
  • Permitted must monitor the burn at all times until the fire is extinguished
  •  A permit can be revoked by any member of Elbert Fire Protection District at any time for any reason
  •  If unable to burn on day requested, contact EFPD with original permit number and date and request a re-issue permit to burn up to 15 days from original permit, at no charge. Any re-issue permits greater than 15 days will require a new site inspection, and a new permit issued
  •  Permitted must extinguish burn if any of the following situations occur:
  1.  Neighbors complain of smoke or odor
  2. Winds becomes too strong or significant gusts (5 MPH gust over 10 MPH)
  3.  Permitted can no longer monitor burn
  4. Permitted is instructed to extinguish the burn by any member of EFPD

SITE INSPECTION REQUIREMENTS

  • Burn area must be 100’ away from all structures 
  • A 25’ clearance away from combustible material (Hay Stacks, Lumber Piles, etc.), ground vegetation, and tree canopy's 
  • Burn area must have adequate access and egress for emergency situations 
  • Burn area must be reachable by a charged garden hose or have an approved extinguisher/water source on site 
  • Items to be burned shall be fibrous, non-treated wood products in a pile no greater than 9 cubic feet unless special permission is granted by the Chief or an appointed designee. BURNING IN BARRELS IS NOT ALLOWED BY LAW! 
  • NO TRASH 
  • NO Entire trees 
  • NO Mattress 
  • NO Treated wood 
  • NO Laminated wood 
  • NO Building material 
  • NO Furniture 
  • NO Hazardous Materials

All burning will follow the state standards listed in the Colorado open burning information and the Air Quality Control Commission Regulation 9.

NOTE: $10.00 permit application and processing fee will be due before receiving permit.
